THE CALIFORNIA ARREST PROCESS:
When a person is arrested, they are taken to a local police station for processing and booking. Processing and booking can take several hours.
Once the defendant is booked:
– the defendant may be released with no charges filed.
– bail and arraignment may be set by the jail or court. The defendant must post the bail bond amount or make arrangements with a bail bond service to have a bond posted on their behalf in order to get out of jail.
- Defendant may be released on their Own Recognizance (the basis for a judge allowing a person accused of a crime to be free while awaiting trial, without posting bail, on the defendant’s own promise to appear and his/her reputation).
BAIL BOND INFORMATION AND PROCESS FOR BAILING SOMEONE OUT OF JAIL
A friend, relative, a loved one, or the defendant will contact a bail bond service agent by phone or email. The bail bonds agency will collect information about the defendant, such as the charges filed, reason for arrest, bail information and the amount of bail set for release, to begin the paperwork, asses risks involved and process the approval.
Once paperwork is filed and approved, a licensed bail bondsman will post bail at the detention center which will result in the release of the defendant. This process should take no more than a couple of hours, depending on the defendants situation. The bail bond service fee is generally 10% of the full bail amount (mandated by CA state law).
